These terms cover every purchase made from Tuofo (tuofo.ca), a shop operated from British Columbia, Canada by Gagahoho Trade Corp. When you place an order you are agreeing to them, so we have written them the way we would explain them across a counter: in plain sentences, with nothing hiding in the folds. They apply to your order together with the shipping and returns page they refer to, which is part of these terms, and they are the whole of the agreement between us for that order.
All prices on this site are in Canadian dollars. Canadian sales tax is calculated at checkout and shown before you pay: GST across Canada, HST in the provinces that combine the two, and PST when your order is a British Columbia sale, because that is where we are registered to collect it. Which of these applies depends on the address your order ships to, or on our own province when you choose pickup, and the checkout works it out before any money moves. The total you see at checkout is the total you are charged; there are no handling fees, no surcharges arriving with the parcel, and nothing added after the fact.
Ordering is deliberately simple. You add what you want to your bag, check out as a guest with an email address, and pay by card; there is no account to create and no password to invent. The email address matters, because it is where your confirmation, your receipt, and any news about your order arrive. Your order is accepted the moment your payment succeeds and we email you a confirmation; that email is the record of the sale. Every amount you are charged is calculated on our servers, from our own catalogue, at the time you pay, so the price on the page, the subtotal in your bag, and the figure on your statement come from the same place and cannot quietly disagree. Checkout accepts major credit and debit cards, processed by our payment provider over an encrypted connection, and your card details go to that provider directly, never touching our servers; what we keep is the record of the sale, not the card that paid for it.
We start on an order almost as soon as it lands, and that is why we cannot promise a cancellation once it is placed. If you change your mind, write to us at info@tuofo.ca right away with your order number; while an order has not left our hands, we will tell you honestly what is still possible, and once it ships, the returns section below takes over. Honesty runs both ways. If a listed price or a stock level is wrong because of an error, we may cancel the affected order and refund you in full, and we will tell you it happened rather than leave you wondering. We may also decline or cancel an order we reasonably believe is fraudulent. Any order we cancel, for either reason, is refunded to the original payment method.
The catalogue is chosen piece by piece, and stock is exactly what it says it is. When something runs out, the listing says so instead of taking your money, and the checkout re-checks stock as you check out, so it is very hard for two people to buy the last one. If that ever fails us and an order slips through for something we no longer have, we cancel it, refund it in full, and tell you. Products also leave the shelf for good: when something is retired it does not come back as a surprise restock at a different price, it is simply gone. We do not run backorders or waitlists right now, so if you want to know whether something is coming back, ask us and you will get a straight answer.
Orders leave our hands within two business days of payment and ship with Canada Post, anywhere in Canada. The rates, the free-shipping threshold, and the transit times live on the shipping and returns page, which is part of these terms; as a rule, transit is 3 to 5 business days for most of the country and longer for remote addresses. When your order ships we email you the tracking number, and from that point the carrier's tracking is the authority on where your parcel is; delivery estimates are estimates, not promises. Responsibility for the goods passes to you when the parcel is delivered to the address you gave us, so check that address carefully at checkout; we pack every order against the address on the screen, and we cannot answer for a parcel delivered faithfully to the wrong door.
If you are local, you can choose pickup in New Westminster, British Columbia at checkout instead. We email you the exact address once you have paid, and we arrange a time that suits you; bring your order number when you come. A pickup order becomes yours the moment it is handed over. We hold paid orders for 30 days, and if an order is still with us after that and we have not heard from you, we treat it as cancelled and refund it to your original payment method.
You have 14 days from delivery to start a return, and a returned item needs to come back unused, in its original condition and packaging; these are objects we stand behind, and the next person deserves to receive them the way you did. Write to us at info@tuofo.ca with your order number before sending anything back, and we will confirm the return address and walk you through the steps. Return postage is yours, unless the return exists because of our error. Refunds go to your original payment method once the item arrives back and checks out, and banks usually post them within five to ten business days; original shipping charges are not refunded unless, again, the mistake was ours. We do not process exchanges directly: return the item for a refund and place a new order, which is faster for you than waiting on a swap.
If your order arrives damaged, defective, or simply not what you ordered, that one is ours. Report it within 7 days of delivery with your order number and a photo, and we will make it right at our cost, with a replacement or a full refund, shipping included. Do not send anything back until we confirm; often you will not need to. Nothing in this section takes away rights the law gives you.
We describe every product plainly and photograph it honestly, and each listing carries what we know about the piece. Even so, colours render differently from screen to screen, and natural or handmade materials vary from piece to piece; that variation is part of what these objects are, and reasonable variation of that kind is not a defect. If a listing leaves you with a question, ask before you order and we will answer it straight. We would rather lose a sale than have a parcel arrive as a disappointment.
The words, the photography, and the design of this site belong to Tuofo or to the people who licensed them to us. Share them, link to them, save them for later; that is what they are for. Reproducing them commercially, scraping the photography for another storefront, or passing the work off as your own is a different matter, and we ask that you not do it without written permission first.
Buying here asks very little of you: an email address, a delivery address, and a payment whose details we never see. What we collect, why, who touches it, and the rights you have over it are set out in full in the privacy policy. It is short for a policy, because the answer to most of its questions is that we collect little and sell none of it.
Nothing in these terms limits the rights you have under applicable consumer protection law, including British Columbia's Business Practices and Consumer Protection Act and its Sale of Goods Act; where the law gives you more than these terms do, the law wins. Beyond what those laws require, our responsibility for any order is limited to the amount you paid for it, and we are not liable for indirect or consequential losses. Nor are we liable for delays and failures caused by events outside our reasonable control; a postal strike, a carrier disruption, or an outage at one of the services that runs this site are the obvious examples. What we will do in every one of those cases is tell you what is happening and put it right wherever putting it right is in our hands.
Changes to these terms
We may update these terms from time to time, as the shop grows or the law asks. The version posted on the day you place your order is the one that applies to that order, and the date at the top of this page tells you which version you are reading; we do not change the rules on an order after it exists.
Governing law
These terms are governed by the laws of British Columbia and the federal laws of Canada that apply there.
